If you are an Android user in the United States, you may qualify for a share of the $135 million Google settlement. The case centers around Android phones using mobile data in the background without user permission. The court granted preliminary approval for the settlement amount, though final approval is still pending.
Both sides reached a resolution through a settlement
Speaking of the lawsuit, plaintiffs claim that Android devices transfer a variety of information to Google, consuming users’ cellular data. They also allege that some data transfers happen in the background without any notice to the user. This includes times when the phone is completely idle with all apps closed.
While the court has not yet ruled on whether Google violated any laws, both sides have agreed to settle the case. The settlement is worth $135 million and has already received preliminary court approval. The next hearing is scheduled for June 23, after which the court will decide whether to grant final approval to the settlement.
If approved, the settlement could include around 100 million class members. You may be eligible if you are a natural person in the United States. Make sure you used an Android phone to access the internet through a mobile carrier’s cellular data network between November 12, 2017, and the date the settlement receives final approval. Note that you will be excluded from the settlement if you are a class member in a similar case, Csupo v. Google LLC in California.
As of now, it’s unclear how much money each eligible person will receive. The settlement fund will first cover administrative costs, taxes, attorneys’ fees, and other expenses. The remaining money will then be split among eligible users. Since the number of users is large, individual payments could be small.
To get payment, make sure you complete a payment method selection on the Payment Election Form. If you do not take action, the settlement administrator will still attempt to send payments automatically. However, there is a possibility of missed payments.
